ACCOMMODATION RULES – RELAX PENSION SCHÖNWALD

1. Basic provisions
1.1 These accommodation rules (hereinafter referred to as the “accommodation rules”) govern the rights and obligations of the operator of Relax Pension Schönwald and the guests accommodated in the pension (hereinafter referred to as the “guest” or “guests”) from the moment of arrival to the end of the stay.

1.2 The reservation of services is governed by the separate general terms and conditions of the pension. By arriving at the pension, the guest confirms that he has been acquainted with these terms and conditions and undertakes to comply with them.

1.3 These accommodation rules are published at the reception of the pension and on the pension’s website.

2. Price for accommodation and services
2.1 The guest is obliged to pay the price for accommodation and related services according to the valid price list. Payment is made in advance upon arrival or as agreed with the operator.

2.2 In the event of early departure, the guest is not entitled to a refund of the amount paid, unless otherwise agreed.

2.3 In the event of non-use of the reserved and paid services by the customer for any reasons on the customer’s part or without stating the reasons in full (early departure from the stay, later date of arrival), the customer shall not be entitled to any financial or non-financial compensation, substitute performance or compensation for damage.

2.4 The operator reserves the right to individually assess and determine the legitimacy of the customer’s request for possible compensation for non-use of the reserved and paid services in full for serious reasons on the customer’s part (e.g. accident, serious illness, death, etc.), and for the purposes of assessing such a customer’s request, the customer is obliged to prove to the operator the existence and duration of serious reasons (e.g. by a hospitalisation certificate, medical report, death certificate, etc.). In these cases, the customer has no legal right to compensation.

3. Accommodation conditions
3.1 Check-in is possible from 2:00 p.m., check-out by 10:00 a.m. Other times can be agreed individually with the reception. A guest who does not arrive by 24:00 without prior notice loses the right to the reservation.

3.2 Upon arrival, the guest must present an identity document (ID card, passport or other document) in accordance with which he/she will fill out the registration form. Without this document, it is not possible to accommodate the guest.

3.3 Only designated areas are reserved for smokers. Smoking is prohibited inside the guesthouse. If a guest violates the smoking ban in the guesthouse room or other areas of the guesthouse, the operator is entitled to a contractual fine of CZK 5,000, which the customer is obliged to pay to the operator no later than at the end of the stay (check-out) in cash or by payment/credit card at the guesthouse reception. If, as a result of violating the smoking ban in the guesthouse room or in any other areas of the guesthouse, damage occurs to the property of the operator and/or the guesthouse and/or the property, life or health of the operator’s customers or employees, the customer is obliged to compensate for the damage incurred in full.

3.4 Guests are obliged to maintain cleanliness and take care of the protection of the guesthouse’s equipment. Any damage caused by the guest will be compensated according to the extent of the damage. Guests will check the condition of the equipment after entering the room and report any defects immediately to the reception.

3.5 Night silence is set from 10:00 PM to 6:00 AM. Guests are obliged to respect the peace of other guests and not disturb them with noise, including loud music, television or conversations.

3.6 Pets are allowed in the guesthouse on condition of presenting a valid vaccination certificate. Conditions for accommodation with pets:

Animals may not disturb other guests or damage the guesthouse’s property.

A maximum of one medium or large breed animal per room, or two small animals.

The owner is responsible for any damage caused by the animal and is obliged to pay for it in full.

Violation of the rules may be a reason for immediate termination of the stay without compensation.

3.7 Children under 10 years of age may only move around the guesthouse premises under the supervision of an adult. The prohibition of leaving children unattended also applies in the vicinity of the outdoor swimming pool.

3.8 In any premises of the guesthouse (guesthouse rooms, common areas, restaurant, wellness, etc.) it is not permitted to make any changes to the equipment, facilities, or interfere with electrical or any other installation or move equipment without the consent of the guesthouse owner.

3.9 It is not permitted to use your own electrical appliances in the guesthouse room, with the exception of electrical appliances used for personal hygiene (razor, epilator, etc.) and chargers for mobile phones or tablets or laptops.

3.10 Nighttime quiet in the guesthouse is from 10:00 p.m. to 6:00 a.m. The customer’s behavior in the guesthouse during nighttime quiet must not disturb other customers. It is not appropriate to have a loud TV, talk loudly, sing, have loud conversations in the corridors of the guesthouse, on the terrace of the guesthouse or other noisy activities, including increased volume during intimate activities. Social events (celebrations, weddings, etc.) can be organized in the hotel after 10:00 p.m. only with the prior consent of the guesthouse owner.

4. Liability of the operator and the customer for damage
4.1 The operator is liable for damage incurred by the customer during their stay in the guesthouse in accordance with the relevant provisions of the Civil Code and other generally binding legal regulations valid and effective in the Czech Republic.

4.2 The guest is obliged to use the safe located in each room of the guesthouse to store their valuables, money and personal documents. The guesthouse assumes responsibility only for money and valuables stored in the safe at the reception, based on a written and mutually signed inventory of goods. In other cases, the guesthouse is not liable for any loss.

4.3 The customer is obliged to assert claims for the operator’s liability for damage within the deadlines and in the manner specified in the relevant provisions of the Civil Code and other generally binding legal regulations valid and effective in the Czech Republic.

4.4 Items forgotten by guests in the guesthouse are registered and stored for a period of 3 months. After this period, the guesthouse hands over the forgotten items for disposal. The guesthouse will deliver forgotten items to the customer only upon request by the guest house within the period specified in the first sentence of this point and exclusively at the customer’s expense.

4.5 The customer is liable for damage caused by him or by persons for whom he is liable to the property of the operator and/or the guesthouse, as well as to the life, property or health of the operator’s employees or other customers. The customer is obliged to compensate the injured party (operator or customer or employee) for any damage caused in this way in accordance with the relevant generally binding legal regulations.

4.6 The operator is entitled to request a guarantee from the customer in the form of a pre-authorization on the customer’s payment or credit card or another form of financial guarantee, whereby by indicating the guarantee on the registration form or a special form, the customer gives his consent to the guarantee and its use for the purposes of payment of services used by the customer and not paid for (e.g. consumption in the minibar, unpaid services, etc.) or compensation for damage caused by the customer or persons for whom he is responsible, during his stay in the pension, or for the payment of other claims of the operator in connection with the customer’s stay in the pension. The customer is informed about the conditions, form and amount of the guarantee by the reception staff when registering for the stay.

5. Claims from defects in services – Complaints Procedure
5.1 Information on the conditions and method of exercising rights from the operator’s liability for defects (hereinafter referred to as “complaints”), including information on where he can make a complaint and the procedure for making a complaint about the services provided in the pension, is regulated in the Pension’s Complaints Procedure, which is available at the pension’s reception.

6. Personal data protection, Privacy protection
6.1 Information regarding the protection of personal data is provided in the Privacy Policy and the processing of personal data is published on the website www.relaxpension.cz/personal-data-protection

7. Final provisions
7.1 Relax Pension Schönwald is entitled to change these accommodation rules, and such a change is effective for guests from the date of publication of the changed wording of the accommodation rules on the pension’s website. The wording of the accommodation rules valid and effective on the date of the guest’s arrival is decisive for the guest’s stay.

7.2 The customer is obliged to comply with the provisions of these accommodation rules. If the customer violates the provisions of these accommodation rules, or if he does not follow the instructions of the pension staff, or damages or endangers the property of the operator, damages or endangers the health, life or property of its employees or customers, or despite a warning grossly violates good morals or his obligations arising from the accommodation contract or interferes with the good reputation of the operator, its employees or customers, the operator has the right to withdraw from the accommodation contract and expel the customer from the pension without compensation and not allow him to use the services in the pension.

7.3 These accommodation rules, as well as all legal relationships arising on the basis of the accommodation contract, are governed by the legal system of the Czech Republic. All legal relationships not regulated by these accommodation rules are governed by generally binding legal regulations valid in the territory of the Czech Republic.

7.4 Any dispute arising from the accommodation contract, including a dispute over the interpretation of these accommodation rules, in the event that an amicable resolution of the dispute is not reached between the parties to the legal relationship, shall fall within the jurisdiction of the Czech courts.

7.5 If any of the provisions of these accommodation rules is or becomes invalid, ineffective or unenforceable, such invalidity, ineffectiveness or unenforceability shall not affect the validity and effectiveness of the other provisions of these accommodation rules.

7.6 These accommodation rules apply to the regulation of rights and obligations during the customer’s stay in the guesthouse. If the accommodation contract concluded between the operator and the customer or special terms and conditions or rules relating to individual services provided in the guesthouse (e.g. wellness, swimming pool, etc.) (hereinafter referred to as “special conditions”) contain provisions different from these accommodation rules, the provisions of the special conditions are decisive and the provisions of the special conditions take precedence over the provisions of these accommodation rules. In matters not regulated by the special conditions, the provisions of these accommodation rules apply.

7.7. These accommodation rules come into force and effect on 01. 01. 2021
